REGULAMENTO INTERNO Artigo Primeiro

These Internal Regulations are applied to all users of the Aquaparque Madeira, its employees and all those who perform external functions related with the Park.

2nd Article
1. A DESABAFOS DE VERÃO, é responsável pela exploração de todo o recinto

do Aquaparque de Santa Cruz.

2. DESABAFOS DE VERÃO may assign, in whole or in part, the exploitation of existing or new commercial spaces to companies that have an interest in their exploitation.

3rd Article

Aquaparque facilities are all those that are delimited by a net and exterior walls, including the area that constitutes the enclosure with aquatic amusements, support and service facilities, leisure areas and circulation areas.

4th Article

1. O Aquaparque está aberto de Segunda a Domingo, das 10h00 às 18h00 de 24 junho a 10 setembro.

2. O preço de entrada para o público em geral é de € 20,00 (Vinte Euros) bilhete normal e de € 15,00 (Quinze Euros) para crianças entre os 5 e 12 anos de idade. Crianças de idade inferior a 4 anos não pagam.
Para utilizadores, que comprovem através do cartão SIMplifica, que são residentes, terão um desconto de 5€ nas respetivas tarifas.

These prices include our Bird Show.

3. Para ATLs o preço de entrada é de € 8,00 (Oito Euros) por criança com entrada gratuita de um monitor por cada 10 crianças. Aos restantes monitores serão cobrados os valores de tabela. Crianças de idade inferior a 4 anos não pagam. Neste preço está incluído um Show de Aves.

4. Admission to the Park is always preceded by the respective ticket that must be requested at the entrance, in the reception services, and which, after issuance, will never be refunded to the user as long as the Park is in operation.

5. The payment of the ticket allows the user to circulate in all entertainment areas, to participate/interacte and attend to the Bird Show.

6. Aquaparque is free to launch promotional campaigns at any time of the season, which will be published in a timely manner in the media and/or social networks and its website.

5th Article

The maximum instant capacity allowed in the Park is 999 (Nine hundred and Ninety-Nine) people.

6th Article - Park User's Rights

1. The user's rights are:

a) Enjoy a clean and safe Park;

b) Be treated by all Park employees with respect;

c) Participate in all the amusement activities of the Park;

d) Take advantage of equipment and support facilities in perfect conditions of use and functioning;

e) Be informed of all park's operation rules, or any other matter that has to do with the operation of the enclosure, whenever requested.

7th Article

1. All Park users must comply with the rules for the correct use of the facilities and follow all instructions posted by the enclosure.

2. The Park's general rules are:
– Aquaparque reserves the right of admission to its facilities, which will be governed by the corresponding legal and regulatory provisions;

– Aquaparque may expel from its facilities any visitor who does not comply with the rules, who maintains conduct that disturbs other visitors, who is a risk to their own physical integrity as well as to the integrity of other visitors. In either case, there will be no right to any refund.

– Não é permitido correr pelo parque nem fazer uso indevido do mesmo. – É obrigatório cumprir as indicações dos funcionários do parque.

– Access to the park in possession of firearms, bladed weapons or any sharp objects is strictly prohibited.

– For hygiene and safety reasons, access to the park with food and drinks is not allowed.
– The entry of animals is prohibited.

– For everyone's safety, Aquaparque reserves the right to inspect backpacks, bags, or any other transport equipment, in order to ensure compliance with all the above points. Failure to consent to this inspection will be grounds for being denied access to the park.

– For greater enjoyment of the visitor, it is recommended to wear appropriate clothing and footwear.

– It is forbidden to enter the park with skates, scooters, bicycles, and other similar objects, as they pose a risk to both visitors and equipment.

– It is forbidden to enter the park with narcotics. Consumption or sale of the same will be grounds for expulsion from the park without the right to reimbursement.

– If you leave the Aquaparque grounds, the same reserves the right to charge a new ticket, unless expressly authorized by an Aquaparque manager.

– Aquaparque may suspend the sale of tickets whenever the excessive influx of public jeopardizes the proper functioning of the park and the enjoyment of its facilities in full.

– Aquaparque is not responsible for objects lost on its premises.

– For the visitors' own safety, the attractions have restrictions on their use for reasons of age, height, physical and mental conditions. If the visitor, for any of these reasons, is unable to enjoy any of the attractions, he will not be entitled to a refund.

– For greater user enjoyment, attractions, games and shows have their own rules and were designed for your benefit. Respect them.

– Aquaparque reserves the right to change the opening and closing hours of the park, as well as suspend the operation of any attractions and shows whenever weather, technical, operational reasons or any other force majeure reasons advise it.

– Aquaparque can hold events within its facilities.

– It is prohibited to sell street vendors or resale products by users of the park.

– It is forbidden to eat by the pools, throw garbage on the ground, the park has its own spaces for meals, garbage disposal and ashtrays.
– It is forbidden to enter barefoot in any enclosed area of the park.

– The use of glass bottles or any other glass object is prohibited.

– The park has music that covers the entire enclosure, so the entry of musical equipment, with the exception of headphones, is prohibited.

– Sun beds and umbrellas are paid for, can only be used in the appropriate places (swimming pool solarium) and their displacement to other areas is prohibited. The use of umbrellas that do not belong to the Park is prohibited.

– Children under 12 years old must be accompanied by an adult at all times.

– Pregnant women and people suffering from a heart condition or who have any other medical problem that could have consequences for their health should not attend extreme attractions.

- No user may interrupt the surveillance activity of the Park's monitors.

– Ao Diretor do Parque assiste o direito de decidir o encerramento deste, por motivo de segurança ou avaria grave, ou qualquer tipo de ameaça que ponha

em causa a segurança das pessoas, sem que o utilizador possa exigir a devolução da quantia paga.

– This may be done in particular when the general and specific rules for each of the attractions are not respected, or when alcohol or other drugs are clearly consumed that could jeopardize the security of the Park.

– No amount will be refunded if, once inside the Park, there are weather changes or bad weather that cause the decision to close its facilities.

– It is forbidden to practice nudism or topless inside the park.

The Park's specific rules are:

– Respect the monitors' instructions.

– Regulatory position: feet first, seated and hands always on the inside.

– It is not allowed to make “horses” or “trains” movements.
– It is not allowed to wear piercings, jewelry, glasses or any metallic element on the slides.

– It is forbidden to put your hands outside the slides.

– It is mandatory to leave the finish area quickly.

– It is not allowed to run or push.

– Diving is not allowed.

– It is forbidden to stand up, move around or leave the premises at the intermediate point.

8th Article - Employees' Rights

Employees' rights are:

a) Be treated by all Aquaparque members with respect;

b) To be informed as necessary on all matters concerning them;

c) Have all the necessary conditions for the good performance of their tasks;

9th Article - Employees' Duties

Employees' duties are:

a) Be punctual and diligent in the performance of their duties, and actively participate in the activities of the Park;

b)Desempenhar as funções com disciplina, interesse e espírito de equipa; c)Incentivar boas regras de convivência entre os utilizadores do Parque; d)Atuar de forma responsável e atenta nos postos de trabalho;
e)Tratar todos os utilizadores do Parque com respeito e correção; f)Executar todas as tarefas para as quais foi contratado;

g)Keep all the Park's facilities clean and conserved;

h) Report any occurrence, damage or loss, as soon as you become aware of it, even if it is not directly related to the functions you perform;

i) Be aware of the space that is your responsibility and immediately report any irregular situation to the Park Management;

j) Remain in the place assigned to him during the stipulated time, not leaving it without superior authorization;

l) Treat colleagues with respect and correction;

m) Perform other tasks previously or later defined and agreed with the Board, and be able to adapt to new instructions that may be issued;

n) Supervise children permanently and responsibly;
o) Wear the clothing imposed by the Board in the best hygienic conditions.

10th Article - Maintenance Employees' Specific Duties

a) Ensure the conservation of facilities, equipment and furniture;

b) Ensure the regular operation of equipment and installations, and carry out all necessary repairs;

c) Examine and maintain swimming pools in good condition and use, immediately reporting any anomaly detected.

11th Article - Maintenance Employees' Specific Duties

a) Ensuring the order and correct functioning of activities;

b) Ensuring that all the specific rules of the activities under its responsibility are complied with;

c) Perform all tasks related to their position and others that may be established by the Board;
d) Assure that users are seated and in a safe condition at the beginning of each slide, and that they leave the place of arrival quickly and without danger;

12th Article - Restaurant Employees' Specific Duties

a) Prepare meals with respect for hygiene and food quality standards;

b) Serve all customers with respect, correction and friendliness;
c)Keep the kitchen and terrace in the best hygienic conditions; d)Use the clothing imposed by the Board in the best hygienic conditions.

13th Article - Animation Staff's Specific Duties

a) Treat all users of the Park with respect and correction;

b) Respect the integrity of the goods and all the equipment used in the activities;

c) Promote quality activities, encouraging children to have a spirit of joy and animation;

d) Treat all children with care and correction;
e)Manter os utentes informados sobre todas as atividades e eventos do Parque; f)Vigiar as crianças de forma permanente e responsável;
g) Wear the clothing imposed by the Board in the best hygienic conditions.

14th Article - Reception Employees' Specific Duties

a) Treat all Park users with respect and correctness;

b) Prudently and responsibly manage the income from the entries, register and other functions imposed on them by the Board;

c) Be friendly and provide all the information or clarifications that are requested;

d) Diligently control the entry of users and visitors;
e) Wear the clothing imposed by the Board in the best hygienic conditions.

Artigo Décimo Quinto – Deveres específicos dos Funcionários da Loja

a) Treat all customers with respect and correctness;

b) Serve in a friendly manner, and respond to all information requested about the objects found inside the Store;

c) Responsible management of the sales proceeds, complying with all instructions transmitted by the Board;

d)Use the clothing imposed by the Board in the best hygienic conditions.

Artigo Décimo Sexto – Deveres específicos do pessoal de Socorrismo

a) Correctly assess the accident situation, keeping the Management informed of any emergency situation occurring at the facilities;

b) Immediately request external means of help whenever necessary;

c) Remain at their job when there is no occurrence, not leaving without authorization from the Board.

17th Article - Cleaning Staff's Specific Duties

a)Keep the entire Park enclosure clean;

b) Ensure the conservation of material and equipment, as well as the facilities in general.

18th - Rescue Staff's Specific Duties

a) Carefully monitor users, ensuring their physical integrity, not allowing any violation of the established rules;

b) Provide first aid in case of accident or sudden illness.

19th Article

1. The Aquaparque's Management is the responsibility of a Director, without prejudice to the competence and hierarchical power of the concessionaire company.

2. The Director is responsible for the order and correct functioning of all activities, as well as for the fulfillment of the objectives set by the Concessionaire.

3. The Director remains on the premises during the entire period of operation, and may be replaced by a person designated by him, who will assume his responsibilities during the period of impediment or absence.

20th Article

1. The behavior that results in the violation of one or more general or special duties, constitutes an infraction susceptible of application of disciplinary measure, and covers all those who are bound by the present Regulation.

2. Aquaparque's Management Teams are responsible for the application of this regulation, and will resolve omissions in accordance with the legislation in force on the matter, and in the absence thereof, based on the principles of common sense and common practice.

3. These Internal Regulations will be subject to alterations whenever justified, thus guaranteeing their adequacy to the reality of the Park.

4. In all that is not foreseen, all legal provisions relating to the operation of aquatic amusements will be followed, namely the Regulatory Decree in force.
